FirstCallAI · Effective 5 October 2026
Mason David Ventures L.L.C., doing business as David Legacy Software (“we”, “us”) provides FirstCallAI, an answering service that funeral homes use to handle phone calls and text messages. Effective date: October 5, 2026. Contact: contact@davidlegacysoftware.com.
Who this applies to
When you call or text a funeral home that uses FirstCallAI, we handle your call or message on that funeral home’s behalf. The funeral home decides why your information is collected. We process it only to provide the service to the funeral home.
What we collect
- Your phone number, from caller ID or the number you text from.
- Your name, if you give it to us.
- What you tell us, such as the name of the person who has died, their location, your relationship to them, and the reason for your call or text. For calls we keep a text transcript of the conversation. We do not store audio recordings of calls.
- Call and message details, such as date, time, call outcome, and whether a staff member was notified.
- Follow-up requests, if you ask for a call back or pre-need information.
How we use it
- To answer your call or text and give you the funeral home’s information.
- To notify the funeral home’s on-call staff so they can reach you.
- To let the funeral home review calls, messages and follow-up requests in its dashboard.
- To keep the service secure and working.
We do not use your information to advertise to you, and we do not sell it.
SMS (text messages)
You receive text messages from us only after you text the funeral home’s number first. Our replies are sent in that conversation. We do not send marketing or promotional text messages. Message and data rates may apply. Reply STOP at any time to stop receiving messages, or HELP for help.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
Who we share it with
- The funeral home you contacted, and its staff.
- Service providers that run the service for us: Twilio (calls and texts), Anthropic (the AI model that writes replies), ElevenLabs (the spoken voice), Google (maps and place lookups), and our hosting and database providers. They may process your information only to provide their service to us.
- When the law requires it.
How we protect it
Names and phone numbers are encrypted when stored. Access is limited to the funeral home’s authorized staff and to us as needed to run and support the service. Data is stored in the United States.
How long we keep it
We keep call and message records for as long as the funeral home needs them or the law requires.
Your choices
To ask what we hold about you, or to ask for correction or deletion, contact the funeral home you reached or write to contact@davidlegacysoftware.com. We will pass the request to the funeral home where needed.
Children
The service is not directed at children under 13.
Changes
We will post changes on this page and update the effective date.
